MCA Alberta offers education and training programs through a variety of learning opportunities designed to meet unique mechanical and service contractor needs. This is accomplished through member meetings, short seminars and full day courses. These feature guest presenters on broad industry topics, product specific technical training, HR and other soft skills training, business skills and succession planning.

Programs are designed specifically for owners and senior management, service managers and technicians, HR leaders, frontline field and office staff to keep the entire team current and to help grow your career.

Termination of Employees in the Construction Industry

It is a common misconception that all workers employed by construction companies are not entitled to reasonable notice of termination of their employment. While Section 5 of the Employment Standards Regulation (“ESR”) allows construction employees to be dismissed without notice or pay in lieu of notice, there are notable exceptions for:

  • Employees employed to perform ongoing maintenance, and
  • Office employees, which can include all manner of construction staff whose primary role is not limited to working at a construction site.
  • Long term employees, including those limited to working at construction sites.

Russell Patterson from Goodfellow & Schuettlaw will discuss the nuances of including employee termination clauses in new employment contracts, the appropriate means of updating employment contracts to include employee termination clauses and best practices to avoid employee termination conflict. Sample copies of tested termination clauses will be provided.
